Terms & Conditions

1. General
Unless other arrangements have been made, in writing, the
following conditions for delivery and payments apply to all
transactions between Scalewings and its customers. Any
arrangements, agreements, orders, modifications become binding
only when we confirm so in writing. An order is considered as
placed and received, when it is confirmed in writing by
ScaleWings, or when the item is delivered. |

2. Prices
The applicable prices are the ones listed in the products
listing. All prices are FOB Strasswalchen. Shipping to a
customer’s address is to be paid by the customer, and at his own
risk. Packing, shipping and insurance will be charged at actual
cost. The means of shipping will be chosen by ScaleWings. The
prices include the VAT (value added tax) applicable in Austria.
VAT, customs dues, and other processing fees applicable when
exporting to non - EU member nations are at the customer’s
expense. |

3. Payment
conditions
The item(s) will be shipped when payment is received, or payment
is made upon delivery. In the case of customer pick-up, payment
will be made at the moment of pick-up, if not agreed otherwise.
The form of payment is to be determined by the customer when
placing the order. |

4. Delivery
time
Delivery time is set as per agreement. The agreed delivery time
starts at the moment of pacing the order; however, they are not
binding. We are not responsible to delays due to traffic
problems, or other circumstances beyond out control. In the case
that the complete order is not available for delivery at a
certain point in time, partial deliveries can be made. |

5. Warranty
All of our products are covered by a warranty within the terms
established by law. We will not accept return shipments without
prior agreement. We will not assume the costs of return
shipments. Warranty claims have to be made within one week of
receipt of the item in question. We must be given the
opportunity to correct the defects within a reasonable amount of
time. In the case of accepted claims, we will correct the defect
or replace the item free of charge. We will not compensate for
loss of income or damages caused. |

6. Technical
Data
The technical data published are to the best of our knowledge.
However, we cannot be responsible for data provided by our
suppliers. Due to the fact the all the parts are laminated by
hand, a variation of +/- 20% of weight dimensions is considered
acceptable. |

7. Property
All items remain property of ScaleWings until payment is made in
full. This also applies in the case that the items are modified
or sold to a third party. |

|
8. Liability
Since we cannot control the way in which our products are
assembled and used, we are not liable for damages to properties
or personal injuries caused by our products. |

|
9. Legal Terms
All deliveries and payments are to be made in Straßwalchen.
The relationship between customers and ScaleWings Modelltechnik
GmbH, as well as the terms and conditions are subject to
austrian law.
Legal disputes shall be settled in Neumarkt am Wallersee, or any
other location, if so chosen by ScaleWings Modelltechnik GmbH.
In the case that individual parts of the contract become
partially or totally unapplicable, the validity of the contract
in it’s entirety will not be affected. |
